Terms and Conditions of Sale

These terms and conditions (the “Conditions”) apply only to purchases made through our Website by Consumers (each as defined below).  If you are not purchasing as a Consumer, please contact us for our business terms of purchase.

By purchasing or ordering the Goods or a Subscription, you agree to be bound by the terms and conditions set out below. Before placing your order, if you have any questions relating to these Conditions or about your order please contact us:

Discount and Sales 

Please note that discounts are only offered on supplement products unless otherwise specified. Clothing and Accessories are never included in discount or sales offerings and marketing messaging during sale periods only refers to supplements.

PURESPORT

“Puresport”, “we”, “our” and “us” means Pure Sport Oil Limited (company number SC615410), together with its subsidiary and holding companies and any subsidiaries of such holding companies;

“Conditions” means these terms and conditions;

“Consumer” means someone who is purchasing Goods and/or a Subscription for purposes wholly or mainly outside of that person’s trade, business, craft or profession; 

”Goods” means any goods you purchase under these Conditions;

”Personal Information” means the details provided by you to us;

”Subscription” means a subscription for the supply of Goods on a regular, recurring basis and for which you pay regular, recurring payments to Puresport;

“Working Day” means Monday to Friday on any day which is not a bank or national holiday in London;

“Website” means the website accessed at www.puresport.co or any other URL which may replace it; and

“You/Your” means the person ordering or otherwise purchasing the Goods or Subscription as a Consumer.

1. Rights and Obligations

1.1 You undertake:

1.1.1 to pay any amounts due to us in a timely manner;

1.1.2 that the Personal Information you provide is true, accurate, current and complete in all respects;

1.1.3  to notify us immediately of any changes to the Personal Information using the contact details in Clause 5.4; and

1.1.4  not to impersonate any other person or entity or to use a false name.

1.2 We reserve the right to modify the price or the content or withdraw, temporarily or permanently, some or all of the Goods or Subscriptions available. We also reserve the right to change or add to these Conditions from time to time.

1.3 Unless you have placed an order for any Goods or any Subscription, by the time such a change takes effect, we shall not be obliged to give you notice of any such modification or withdrawal.

1.4 From time to time we may also have to make changes in the specification of any Goods:

1.4.1 as required to  conform with any applicable safety or other statutory requirements; or

1.4.2. to reflect changes in the manufacturer’s specification,

but we will endeavour to ensure that such changes do not reduce the quality or performance of such Goods. Where you have placed an order or purchased a Subscription for the affected Goods and such changes are substantial, we will notify you in advance to ensure that you still wish to proceed with any order that you have placed.

1.5 Goods

1.5.1 You will be subject to the policies and Conditions in force at the time you order or otherwise purchase the Goods or Subscriptions, unless we are legally obliged to make changes to these Conditions that apply retrospectively.If this happens, these changes will apply to any orders we have not yet fulfilled when the changes took effect, even if your order was placed previously.

1.5.2 We shall not withdraw or modify to your substantial detriment any of the Goods for which we have accepted an order from you, other than where such modification or withdrawal is required as a result of events outside of our reasonable control.

1.6 Estimated time frames for delivery of Goods are estimates only and delays may arise due to matters outside of our reasonable control.

1.7 Where ordering Goods from outside of the United Kingdom, you are responsible for complying with any local laws, import controls, taxes, duties and any other regulations which may apply in respect of the Goods in the place of delivery.

2 Orders

2.1 Goods are available only to individuals who we, in our absolute discretion, consider eligible. Subscriptions are only available to individuals who are 18 years old or over and by ordering or otherwise purchasing such a Subscription, you confirm that you are 18 years old or over.

2.2 When requested by us, you must provide your name, phone number, address, payment details and other requested information as required to enable us to process payment for your order and delivery fulfilment.  We will not be responsible for or liable to you for any unfulfilled orders where you have failed to provide complete, accurate and up to date payment, billing or delivery information. 

2.3 Each order placed by you will be treated as an offer to purchase the Goods or Subscription to which your order relates. A binding contract will only be formed between you and us on these Conditions when we dispatch the Goods or commence the Subscription (as applicable) or when we take any due payment from you (which includes debiting your payment method), whichever is the earlier.

2.4 You acknowledge that any automated acknowledgement given when you place an online order shall not amount to our acceptance of your offer to purchase.

2.5 We may, at our own discretion, limit, restrict or reject any order you place at any time prior to the contract having been completed. You also acknowledge that we have the right to cancel any order before it has been dispatched when we have reason to believe that an error has occurred. Where this happens, we will attempt to contact you.

3 Price and Payment

3.1 The price of the Goods or the price of your Subscription for the initial billing period shall be the price of which we inform you prior to accepting your order. Prices include VAT at current rates unless stated otherwise.

3.2 If you fail to make any payment when due then, without prejudice to any other right or remedy we may have, we may cancel this agreement.

3.3 You confirm that any payment method you use is yours.

3.4 Payment methods are subject to validation checks and authorisation and we will not be liable for any delay or non-delivery caused by failure of such checks or authorisation.

3.5 Once your Goods have been delivered to the delivery location set out in your order, all risk of damage to, or loss of, the Goods shall pass to you.

3.6 In the event that Goods have been lost in transit and have not been received by you, we reserve the right to issue you with a replacement for the Goods, subject to a replacement being available. 

3.7 Irrespective of your receipt of the Goods, the passing of risk or any other provision of these conditions, ownership shall not pass to you until we have payment in full for the Goods.

3.8 Until such time as the ownership passes to you, you shall hold the Goods on our behalf and keep them safe and identified as our property, and we shall be entitled to ask you to return the Goods to us.

3.9 Discount codes do not apply to any already discounted items, bundles, apparel, merchandise or accessories.

3.10 On full price products only one discount code may be used. Multiple discount codes do not stack, and are not accepted on our platform. You may remove and change discount codes at will.

4 Cancellation, Returns and Exchanges

4.1 Where purchasing Goods or Subscriptions as a Consumer, you have the right to cancel the contract between you and us within certain periods of time without giving any reason, Information on the applicable consumer cancellation periods and exceptions to these rights for contracts for Goods or Subscriptions can be found at clauses 4.2 and 4.3.

4.2 Consumer cancellation rights: Subscriptions

 4.2.1 You may cancel any order for a Subscription any time within 14 days from the day after you receive the first delivery of the Goods to be supplied as part of your Subscription without penalty (subject to clause 4.2.2 below).

4.2.2 If any Goods have been supplied as part of your Subscription within the above cancellation period, you must return the Goods to us within a reasonable period, complete with any accessories or other items provided  with the Goods and undamaged, with proof of purchase. If you fail to return the Goods in this manner, we may charge you the costs we incur in recovering the Goods from you or withhold from our refund of the price of those Goods as part of your Subscription and the purchase price of any missing or damaged items. If you have purchased any supplements or similar consumable products which were delivered in a sealed container or packaging, you will not be entitled to a refund in respect of these.

4.2.3 If you do not cancel your Subscription within the cancellation period as described above, you will lose the right to cancel your Subscription without penalty. Additional terms and conditions applicable to  Subscriptions including terms for cancellation after your cancellation period has expired can be found at clause 9.
4.3  Consumer cancellation rights: Goods

4.3.1 You may cancel a single order for Goods, not supplied as part of a Subscription, at any time within 14 days from the day after your Goods are delivered to you without liability. If you ordered multiple Goods  under a single Order, this cancellation period applies from the day after the last of the Goods under that order are delivered to you.

4.3.2 If you cancel a contract for Goods, they must be returned to us within a reasonable period, complete with any accessories or other items provided with the Goods and undamaged, with proof of purchase. If you fail  to return the Goods in this manner, we may charge you the costs we incur in recovering the Goods from you or withhold from our refund the purchase price of any missing or damaged items. If you have purchased any supplements or similar consumable products which were delivered in a sealed container or packaging, you will not be entitled to a refund in respect of these.

4.4 Effects of exercise of consumer cancellation rights

4.4.1 You can exercise your statutory right to cancel your contract by providing us a clear statement of your decision to cancel the contract using the contact details found at the start of these Conditions.  You may use the model cancellation form found at the end of these Conditions for this purpose, but this is not mandatory.

 4.4.2 You shall be under a duty to take reasonable care of the Goods until received or collected by us and it is your responsibility to ensure that the Goods are not damaged whilst in transit using transport arranged by you.

4.4.3 Following the exercise of your right to cancel the contract you must return any Goods by sending them to our Returns Team. Please contact us for information on how to return the Goods. We will reimburse you the  cost of your Goods or Subscription (as applicable) as well as delivery charges where you have chosen the least expensive type of delivery we offer no later than 14 days from the day you exercise your right to cancel the contract.  However, we may withhold reimbursement until the earlier of the time we receive the returned Goods, or evidence that you have sent these for return.

4.4.4.The right to cancel does not apply in respect of Goods which are liable to deteriorate or expire rapidly.  For the avoidance of doubt this includes where you have unsealed any supplements or similar consumable products where provided in a sealed container or packaging.  We reserve the right to withhold from your refund an amount equal to the purchase price of any such Goods.

5 Your Personal Information

5.1  We need to collect certain Personal Information to provide you with the Goods and/or fulfil deliveries as part of your Subscription.

5.2 You agree that we may use, update, share and process your Personal Information in accordance with our privacy policy accessed at https://puresport.co/pages/privacy-policy as updated from time to time.

5.3 If you would like us to tell you what information we hold about you please include your full name, address and a copy ID with each request.

5.4 You will have the opportunity to consent to us contacting you by post, email, phone, SMS or MMS about products and services which Puresport believe may be of interest to you.

6 Limitation of Liability

6.1 We will not be liable for any loss or damage caused by us in circumstances where:

6.1.1  there is no breach of a legal duty of care owed to you by us; and/or

6.1.2 such loss or damage is not reasonably foreseeable.

6.2 We will not be liable any loss or damage caused wholly or mainly by your breach of these Conditions.

6.3 Our liability shall not in any event include losses related to any business of a customer including but not limited to lost data, lost profits or business interruption.

6.4 Nothing in these Conditions shall:

6.4.1  exclude or limit our liability for death or personal injury resulting from our acts or omissions or those of our servants, agents or employees; or

6.4.2 limit your rights as a consumer under applicable UK law.

6.5 The Goods, where new, are sold with the benefit of and subject to the terms set out in any warranty or guarantee given by the manufacturer of the Goods. This is in addition to your legal rights in relation to Goods which are faulty or which otherwise do not conform to the legally required standard.

6.6 Each provision of this Clause 6 operates separately. If any part is disallowed, or is not effective, the other parts will continue to apply even after our agreement has been terminated or cancelled.

7. General

7.1 Events Beyond the Parties Reasonable Control: If we are unable to perform our contract with you due to circumstances beyond our reasonable control such as lightning, flood, exceptionally severe weather, fire,  explosion, war, civil disorder, industrial disputes, acts or omissions of persons for whom we are not responsible, or acts of local or central government or other competent authorities, we will not be liable for this.

7.2 Third Parties: Nobody but you and us can benefit from these Conditions or the contract between you and us under the Contracts (Rights of Third Parties) Act 1999.

7.3 Assignment: You may not but we may, assign, charge or otherwise dispose of our rights under these Conditions or any contract you have entered into pursuant to these Conditions. Any attempt by you to do so shall be  void.

7.4 Governing Law: These Conditions will be governed by English Law and if you are not happy with how we deal with any disagreement and want to bring court proceedings, you must do so within the UK.

7.5. Each Clause of these Conditions operates separately. If any part is disallowed, or is not effective, the other parts will continue to apply even after our agreement has been terminated or cancelled.

8. Klarna

8.1 In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

9. Puresport Subscription T&Cs

9.1 If you subscribe to a Puresport Subscription, you may choose your selected frequency period for the supply of Goods included in your Subscription from the options offered by us for the relevant Subscription (the  “Minimum Term”). The Minimum Term will be automatically renewed at Puresport’s then-current fee for such Subscription, unless you cancel your Subscription in accordance with the terms laid out below.

9.2 Unless you cancel your Subscription within the cancellation period as described at clause 4.2 above, you may only cancel your Subscription at any time after the initial Minimum Period and before your upcoming  renewal date. You can do so by logging onto your account at www.puresport.co

9.3 You may pause your Subscription at any time. When you cancel your billing, your Subscription will be placed ‘on hold’ indefinitely. You can reactivate this from within your account.

9.4 All Subscriptions are billed at your selected frequency.

9.5 Goods included in your Subscription will be dispatched the next Working Day after your payment has been taken, unless otherwise stated. Please note we do not offer refunds on products ordered on Subscription other  than in accordance with your Consumer cancellation rights as described at clause 4.2 above.

9.6 Your Subscription will auto-renew and you will continue to be charged, on expiry of the Minimum Term until you choose to cancel or pause your Subscription. You will be billed on the date of each such renewal.

9.7 You agree that your Subscription will be subject to this automatic renewal feature unless you cancel or pause your Subscription before your upcoming renewal date, following the minimum Initial Term by logging into  and choosing to cancel or suspend your Subscription from the “Change/Cancel Membership” page of your “Account Settings” page. 

9.8 You are wholly responsible for maintaining the payment and delivery details associated with your Subscription as required to keep these accurate and up-to-date. We will not be liable for any failure to supply Goods as part of your Subscription due to your failure to maintain these details as accurate and up to date for us to continue charging and fulfilling Goods deliveries as part of your Subscription.

9.9 You agree that we may either terminate or suspend your Subscription for any reason at any time in our sole discretion.

9.10 We reserve the right to make changes to the prices of Goods from time to time.  Where such changes affect the price of your Subscription, we will give you reasonable notice of such changes in advance of any price change taking effect.  If you do not wish to accept a price change or change to your Subscription, you may cancel your Subscription before the change takes effect.

10. 3 FOR 2 T&C's 

10.1 If the Goods are the same price you will receive one free. If they are a different price, you will receive the cheapest free.

10.2 In 3 for 2 promotions, you are purchasing two full price Goods, and receiving a third and product free. If you are returning Goods that were purchased on "3 for 2" promotion, the refund will be calculated  proportionally based on the price of the Goods in relation to the total offer.

11. GIFT WITH PURCHASE T&C's 

On obtaining a free gift with purchase, upon returning Goods that would result in your overall spend dropping below the threshold of the free gift with purchase, the free gift must also be returned. If the free gift with purchase is not returned, the price of that item will be deducted from your refund.
